1. Purpose
These Terms of Service (hereinafter "Terms") govern access to and use of the Stampeo platform (hereinafter "the Platform"), a digital loyalty card service for Apple Wallet and Google Wallet.
The Platform is operated by Harry Viennot, sole proprietor registered in France under SIRET currently being obtained, hereinafter "Stampeo", "we", or "our".
By using the Platform, you agree to these Terms in their entirety.
2. Definitions
- Platform: all Stampeo services, including the website, dashboard, mobile scanner app, and associated APIs.
- Business User: any individual or legal entity creating a professional account on the Platform to manage a loyalty program.
- Employee: any person invited by a Business User to scan customer loyalty cards.
- End Customer: any person holding a digital loyalty card in their wallet, as a customer of a Business User.
- Pass: the digital loyalty card installed in Apple Wallet or Google Wallet.
- Subscription: the paid plan providing access to Platform features.
- Reseller: a third party authorized in writing by Stampeo to manage loyalty programs on behalf of one or more Business Users.
- Founding Partner: a Business User who subscribed during the Founding Partner program window (see §5.3).
3. Access to the Platform
3.1 Business Users
Registration is open to any individual of legal age (18 or older) or legal entity. Business Users agree to provide accurate information and keep it up to date.
3.2 Employees
Employees are invited by a Business User. They must create an account to access the scanning feature. The same employee may be linked to multiple businesses.
3.3 End Customers
End Customers do not need to create an account. They access the service by downloading a Pass to their wallet. Use of the Platform by End Customers is restricted to persons aged 16 or older.
4. Description of Service
Stampeo provides businesses with a platform to:
- Create and customize digital loyalty cards
- Distribute cards via Apple Wallet and Google Wallet
- Scan customer cards to award stamps or points
- Track loyalty program activity
- Send notifications to cardholders
5. Subscriptions and Pricing
5.1 Free Trial
Each new Business User receives a free trial, with no commitment and no credit card required. The trial provides access to all features of the selected tier. The standard trial duration is 30 days. Founding Partners (see §5.3) receive an extended trial of 90 days.
At the end of the trial, the Business User has a 3-day grace period during which the dashboard remains fully functional, allowing subscription without service interruption. After the grace period, if no subscription has been set up, access switches to read-only mode: write operations (customer creation, stamp addition, design changes) are blocked, but data remains accessible and is preserved. Passes already installed in customer wallets remain present but are no longer updated.
Subscribing later instantly restores full access.
5.2 Subscription Tiers
Stampeo offers three subscription tiers. Current public pricing is shown on the pricing page and in the Stripe checkout at the moment of purchase, which is the authoritative source; the table below summarizes the tiers in effect at the date of these Terms.

Prices are all-inclusive. VAT not applicable, Article 293B of the French Tax Code.
5.3 Founding Partner Program
Until May 19, 2026, new Business Users who subscribe before the program closes may join Stampeo's Founding Partner program. The Founding Partner program provides:
- A period of free service at the beginning of the subscription, as displayed in the Stripe checkout
- A discounted price that remains in effect for the lifetime of the Business User's uninterrupted active subscription
The Founding Partner benefit is tied to continuity of subscription. If a Founding Partner cancels or allows their subscription to lapse, and subsequently re-subscribes, they will do so at the public price then in effect; the Founding Partner benefit does not resume.
Founding Partner status is determined at the time of the original subscription and is exempt from future public-price increases for as long as the subscription remains continuously active (see §5.4).
5.4 Payment
Payment is made monthly by credit card via our payment processor Stripe. Subscriptions are automatically renewed each month on the anniversary date. Tier changes (upgrades or downgrades) take effect according to the rules shown in the dashboard at the moment of change.
5.5 Price Changes
Stampeo reserves the right to change its prices. Any change will be notified by email at least 30 days before taking effect. Business Users who do not accept the change may cancel their Subscription before the effective date.
As stated in §5.3, Founding Partners are exempt from public-price increases for the lifetime of their uninterrupted active subscription.
5.6 Trial and Billing Communications
In addition to the notices above, Stampeo sends the following operational emails, which are part of the service and are not subject to opt-out while an account is active:
- Trial expiry warnings (fourteen, seven, and two days before trial end)
- Subscription confirmation and cancellation notices
- Payment receipts and payment failure notices
- Account status changes (e.g. awaiting confirmation, suspension for non-payment)
These emails are transactional and are required for the proper administration of the Subscription.
6. Cancellation
6.1 By the Business User
Business Users may cancel their Subscription at any time from their dashboard. Cancellation takes effect at the end of the current billing period. Access to the service is maintained until that date.
No pro-rata refunds are provided for the remaining period.
6.2 By Stampeo
Stampeo may terminate an account in the event of:
- Violation of these Terms (including the §8 restrictions on broadcast use)
- Fraudulent or abusive use of the Platform, or failure of post-signup fraud or anti-abuse checks
- Non-payment after reminder
- Extended inactivity (more than 12 months without login or scan)
In case of termination for violation, Stampeo reserves the right to suspend access immediately without refund.
6.3 Consequences of Cancellation
After cancellation:
- Dashboard access is deactivated
- Data is retained for 60 days, allowing possible reactivation
- After this period, all data is deleted, including End Customer data
- Passes already installed in customer wallets remain present but are no longer updated
7. Intellectual Property
7.1 Stampeo's Property
The Platform, its source code, interface, design, and features are the exclusive property of Stampeo. The Subscription grants a non-exclusive, non-transferable right to use the Platform for the duration of the Subscription.
7.2 Business User Content
Business Users retain ownership of their content (logo, images, text). By uploading content to the Platform, Business Users grant Stampeo a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for the purpose of operating the service.
Business Users also authorize Stampeo to showcase their loyalty card and logo as commercial references on the Stampeo website (e.g., testimonials, card examples). Business Users may withdraw this authorization at any time by contacting support@stampeo.app.
8. End Customer Data (Data Processing Terms)
This section functions as the Data Processing Addendum between the Business User (as Controller) and Stampeo (as Processor) with respect to End Customer personal data, in accordance with Article 28 of the GDPR. Where the Business User requires a standalone DPA for its own compliance records, these clauses may be relied on as such.
8.1 Roles and Scope
The Business User is the data controller for its End Customers' personal data and determines what information is collected and for what purpose. Stampeo acts as a data processor and processes End Customer personal data only:
- on documented instructions from the Business User (including the configuration of the loyalty program, the content of broadcasts, and any settings the Business User toggles in the dashboard);
- for the duration of the Subscription and the 60-day post-cancellation retention window described in §6.3;
- for the sole purpose of providing the Platform as described in §4.
Stampeo will not use End Customer data for its own purposes, nor combine it with data from other businesses.
8.2 Sub-processors
Stampeo engages the sub-processors listed in the Privacy Policy §4, including technical infrastructure providers and, where applicable, Reseller partners as described in §9.1 of these Terms. That list is the authoritative sub-processor list. Stampeo will provide reasonable advance notice of material changes to the sub-processor list by updating the Privacy Policy and notifying Business Users by email as required by §14.
8.3 Security
Stampeo implements the technical and organizational measures described in the Privacy Policy §11 in line with GDPR Article 32, including encryption in transit, password hashing, restricted database access, per-tenant data isolation, and EU hosting.
8.4 Breach Notification
Stampeo will notify the Business User without undue delay, and in any event within 72 hours of discovery, of any confirmed personal-data breach affecting that Business User's End Customer data, together with the information the Business User reasonably needs to meet its own obligations under GDPR Articles 33–34.
8.5 Assistance, Audit, and Deletion
Stampeo will assist the Business User, at its reasonable request and cost, with:
- responding to End Customer rights requests (access, rectification, erasure, restriction, portability, objection) under GDPR Articles 15–22, including by providing the export and deletion procedures described in the Privacy Policy;
- responding to supervisory authority enquiries and data-protection impact assessments under Articles 35–36.
On termination of the Subscription, Stampeo will delete all End Customer data as described in §6.3, unless retention is required by law.
Stampeo will make available, on reasonable request, information necessary to demonstrate compliance with this section, and will permit reasonable audits proportionate to a SaaS arrangement (typically a written questionnaire plus, where justified, an onsite visit at the Business User's cost, subject to confidentiality).
8.6 Business User Obligations
Business Users agree to:
- Comply with the GDPR and all applicable data protection regulations as controller of the End Customer data
- Publish their own privacy notice to their End Customers (for example on their website or at the point of sale) and inform End Customers, when they are issued a pass, that the business may use the pass to send both transactional and, where applicable, promotional notifications
- Have a valid legal basis for each processing purpose
- Respect End Customer rights under GDPR Articles 15–22 and honor opt-out requests received through any channel (verbal, email, messaging, or otherwise), by excluding the End Customer from future broadcasts or revoking their pass where appropriate
- Not use the Platform to send unsolicited communications in violation of applicable regulations
8.7 Restrictions on Broadcast Use
The promotional broadcast feature relies on the "soft opt-in" exemption of the ePrivacy Directive (Art. 13(2)) and French LCEN Art. L34-5, which applies only where a business markets its own similar products or services to its own existing customers. To keep this legal basis intact and to protect End Customers, Business Users must not use the broadcast feature to:
- advertise, promote, or link to any third party, or to carry advertising on behalf of any third party;
- share, resell, or otherwise make End Customer data available to any other business;
- send content unrelated to the Business User's own loyalty program, products, or services;
- send at an abusive frequency, or in a manner that would reasonably be considered harassment.
Breach of this section is grounds for immediate suspension under §6.2, without refund.
8.8 Data Isolation
End Customer data is strictly isolated per business. Stampeo performs no cross-business data matching.
9. User Obligations
9.1 Business Users agree to:
- Use the Platform in accordance with its intended purpose and applicable laws
- Not resell, sublicense, or provide access to the Platform to third parties except under a Reseller arrangement as described below
- Not attempt to circumvent technical limitations of their subscription tier
- Be responsible for the confidentiality of their login credentials
- Ensure that content published via the Platform does not infringe third-party rights
Reseller arrangements
Any agency or reseller activity (managing loyalty programs on behalf of third-party businesses, or charging additional fees to downstream clients based on the Platform) requires a specific, signed partnership agreement with Stampeo. For inquiries: contact@stampeo.app.
Because a Reseller obtains full dashboard access to each business it manages, including that business's End Customer data, a Reseller acts as a sub-processor in the GDPR chain (the managed business remains the controller, Stampeo is the processor, the Reseller is the sub-processor; see Privacy Policy §4). The partnership agreement must therefore include:
- Purpose limitation (Reseller may access managed-business data solely to operate that business's loyalty program);
- Confidentiality and security obligations consistent with §8.3;
- Sub-processor notification, assistance with End Customer rights requests, and breach response consistent with §§8.4–8.5;
- Data return or deletion on termination of the Reseller relationship;
- Acknowledgement that each managed business remains the data controller for its own End Customer data.
Stampeo may revoke Reseller access at any time in case of breach of this section, misuse of the Platform, or reasonable suspicion of either. No informal or verbal Reseller access is permitted.
9.2 Employees agree to:
- Use the scanner app only within the scope of their duties
- Not share their login credentials
- Respect the confidentiality of End Customer data
10. Availability and Maintenance
Stampeo strives to ensure Platform availability 24/7. However, Stampeo does not guarantee uninterrupted operation and shall not be held liable for:
- Interruptions due to maintenance (scheduled or emergency)
- Failures of hosting providers or third-party services
- Force majeure events
The scanner app functions offline: scans are recorded locally and synchronized when connectivity is restored.
11. Limitation of Liability
To the extent permitted by law:
- Stampeo provides the Platform "as is" without warranty of fitness for a particular purpose
- Stampeo's total liability shall not exceed the amounts paid by the Business User during the preceding 12 months
- Stampeo shall not be liable for indirect damages, data loss, loss of revenue, or loss of profits
- Stampeo is not responsible for the content of loyalty programs created by Business Users or their commercial relationships with their End Customers
12. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium whose performance has begun with the consumer's agreement.
By subscribing and beginning to use the Platform, the Business User acknowledges and accepts the loss of their right of withdrawal.
However, the 30-day free trial without credit card allows testing the service with no commitment.
13. Governing Law and Disputes
These Terms are governed by French law.
In case of dispute, the parties agree to seek an amicable resolution by contacting stampeo at support@stampeo.app. Failing an amicable agreement within 30 days, the following options are available:
For consumer Business Users (individuals), in accordance with Article L612-1 of the French Consumer Code, you may use the following free mediation service:

For professional Business Users, the dispute shall be submitted to the competent French courts.
14. Changes to These Terms
Stampeo reserves the right to modify these Terms. Any substantial modification will be notified by email at least 30 days before taking effect.
Continued use of the Platform after the effective date of modifications constitutes acceptance of the updated Terms.
15. Miscellaneous
- If any clause of these Terms is found to be void or unenforceable, the remaining clauses shall remain in effect.
- Failure to exercise a right under these Terms does not constitute a waiver of that right.
- These Terms constitute the entire agreement between the parties regarding use of the Platform.
